By Judith CrossonEAGLE, Colo. (Reuters) - A Colorado court on Tuesday will hear from more witnesses on whether the sexual history of a 19-year-old woman who has accused basketball star Kobe Bryant of rape should be presented to a jury.
Nine witnesses testified on Monday in a critical closed-door hearing on Colorado's Rape Shield law, which bars defendants from presenting evidence of an alleged sexual assault victim's sexual history at trial unless there is a very strong reason.
Bryant's defense lawyers, Hal Haddon and Pamela Mackey, have said the woman's sexual activity days before and hours after she said she was raped on June 30 last year could explain certain injuries to the genital area she sustained.
The high-profile case has been laden with motions.
The defense wants to see the young woman's diary pertaining to the case and also wants to know how much money a victims' compensation board paid for her therapy. They have asked the court not to refer to the woman as a victim because Bryant has not been convicted.
More witnesses are scheduled to testify behind closed doors on Tuesday, according to court spokeswoman Karen Salaz. But because not all the witnesses will be available, the court will advance to another issue, a defense motion to throw out a taped interview Bryant gave to police about 24 hours after the woman said he raped her.
The suppression hearing on the interview that Bryant did not know was being taped will also be held in a closed session.
No trial date has been set in the high-profile case, although it is expected to take place later this year.
The hearing on the woman's sexual history, which has included testimony from former boyfriends and other acquaintances, is held behind closed doors to protect the woman's privacy.
If District Court Judge Terry Ruckriegle rules that the woman's sexual history should not be admitted at trial, then her privacy will have been protected by closing the pre-trial hearing.
But the young woman seems to have little privacy left. Mainstream media outlets have not identified her, but her name has been all over the Internet. According to a letter her mother wrote to the judge, the young woman has received numerous death threats.
The 25-year-old Los Angeles Laker has denied he raped the woman at a Colorado resort where she worked and he was staying while he had out-patient surgery on his knee.
Instead, Bryant, married and father of a 15-month-old girl, said the two had consensual sex, which he regrets.
The hearing ends on Wednesday.
